Terms of Service

1. Agreement and eligibility

You must be at least 18 years old or the age of legal majority where you live and able to form a binding contract. If you use Kutflow for a business, brand, or agency, you represent that you can bind that organization.

2. The service

Kutflow lets creators upload footage, generate transcripts and AI-assisted cut suggestions, edit clips, add captions or overlays, render videos, and download exports. File, duration, concurrency, storage, and usage limits displayed in the product or plan description form part of these Terms. Features may be added, changed, suspended, or discontinued as the product evolves.

3. Accounts and security

Provide accurate information, keep your credentials secure, and promptly notify support@kutflow.app of suspected unauthorized use. You are responsible for activity under your account and may not share, sell, or transfer access in a way that defeats plan limits or security controls.

4. Your content and permissions

You retain ownership of content you upload. You grant Kutflow a limited, worldwide, non-exclusive license to host, copy, transcode, analyze, modify, display to you, transmit to service providers, and create exports from that content solely to operate, secure, support, and improve Kutflow as described in the Privacy Policy. This license ends when the content is deleted, except for temporary backups, legal retention, and de-identified improvement data.

You represent that you have all rights and permissions needed for your content, including rights to people’s image and voice, music, trademarks, confidential information, product claims, and sponsored or affiliate material.

5. AI output and creator responsibility

Kutflow uses automated systems that can make mistakes, omit context, cut a sentence incorrectly, mistranscribe speech, or produce an unsuitable result. Review every transcript, cut, caption, overlay, and export before publishing. Kutflow does not guarantee accuracy, platform approval, engagement, sales, legal compliance, or any business outcome.

You are responsible for claims, disclosures, permissions, endorsements, affiliate disclosures, product safety statements, and compliance with TikTok Shop, marketplace, advertising, consumer-protection, intellectual-property, and other rules applicable to your content.

6. Acceptable use

You may not use Kutflow to:

• Violate law, another person’s rights, privacy, publicity, copyright, trademark, or contract.
• Upload malware, exploit the service, bypass limits, probe security, scrape at scale, reverse engineer protected portions, or interfere with other users.
• Create or distribute fraud, impersonation, non-consensual intimate content, sexual content involving minors, exploitation, credible threats, or other unlawful harmful material.
• Use another person’s face or voice deceptively or without required consent.
• Resell Kutflow or provide access as a competing hosted service without written permission.

We may remove content, restrict processing, suspend access, or report conduct when reasonably necessary to enforce these Terms or protect people and systems.

7. Plans, free use, and limits

Eligible new users receive one free processed video. Additional free-plan uploads may be stored temporarily without AI processing and presented as subscription-locked, as clearly disclosed in the product. Paid plan allowances reset on the applicable billing cycle, have no cash value, and generally do not roll over. “Unlimited” remains subject to fair use, technical limits, one active processing job per user, and safeguards against automated, abusive, or resale usage.

8. Billing, renewal, cancellation, and refunds

Paid subscriptions are processed by Stripe and renew automatically at the price and interval shown at checkout until canceled. You authorize recurring charges, including applicable taxes. Cancel through Kutflow’s billing portal before the next renewal to avoid the next charge. Cancellation takes effect at the end of the current paid period unless otherwise stated.

Except where required by law or expressly stated at purchase, payments are non-refundable and unused allowances do not create credits. Introductory pricing applies only for the stated period, then renews at the standard price disclosed at checkout. We will provide legally required notice of material price changes.

9. Storage and deletion

Kutflow is not a permanent backup service. Content is subject to the retention periods in the Privacy Policy, including approximately 24 hours for abandoned locked uploads, 7 days for source videos, and 30 days for exports unless retained through an available product control. Download important exports promptly. You may delete projects, but some records may be retained where legally or operationally necessary.

10. Third-party services

Kutflow depends on third-party infrastructure and services, including Supabase, OpenAI, Google Cloud, Stripe, and Resend. Their outages, policies, and terms may affect Kutflow. Links to third-party sites do not imply endorsement, and your use of those services may be governed by separate terms.

11. Suspension and termination

You may stop using Kutflow at any time and may request account deletion. We may suspend or terminate access for material breach, nonpayment, security risk, abuse, legal requirements, or conduct that could harm Kutflow or others. Where practical, we will provide notice and an opportunity to cure. Sections that by nature should survive—including ownership, payment obligations, disclaimers, liability limits, and disputes—continue after termination.

12. Intellectual property

Kutflow’s software, design, branding, models, workflows, documentation, and service content are owned by Kutflow or its licensors. Except for the limited right to use the service under these Terms, no rights are transferred to you. Feedback and suggestions may be used without restriction or compensation, provided we handle personal information under the Privacy Policy.

13. Disclaimers

To the maximum extent permitted by law, Kutflow is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation. Nothing in these Terms excludes rights that cannot legally be excluded.

14. Limitation of liability

To the maximum extent permitted by law, Kutflow and its operators, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of content, revenue, profits, goodwill, or business opportunity. Our aggregate liability arising from the service will not exceed the greater of US $100 or the amount you paid Kutflow during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

15. Indemnity

To the extent permitted by law, you will defend and indemnify Kutflow from third-party claims, damages, and reasonable costs arising from your content, your violation of these Terms, or your infringement of another person’s rights. This does not require you to indemnify Kutflow for its own unlawful conduct.

16. Governing law and disputes

These Terms are governed by the laws of California, without regard to conflict-of-law rules, except that mandatory consumer protections in your home jurisdiction continue to apply. Before filing a claim, contact us and allow 30 days to attempt an informal resolution. Unless applicable law requires otherwise, disputes may be brought in the state or federal courts located in California, and both sides consent to their jurisdiction. Nothing here prevents either party from seeking urgent injunctive relief or using eligible small-claims procedures.

17. Changes and general terms

We may update these Terms to reflect product, legal, or security changes. Material changes will receive reasonable notice when required, and continued use after the effective date constitutes acceptance. If a provision is unenforceable, the rest remains effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without consent; Kutflow may assign them in connection with a reorganization or transfer of the service.
